These Terms of Service constitute a legally binding agreement between you and Goddard Enterprises Inc., a C-Corporation organized under the laws of the State of Tennessee.

4.3 Message Content and Frequency

STOP: Immediately opt-out of all messages
HELP: Receive contact information and opt-out instructions
INFO: Receive program details and consent language
CANCEL or UNSUBSCRIBE: Same as STOP

4.6 SMS Provider and Carrier Fees

Messages sent via goto.com SMS platform
Message and data rates may apply from your mobile carrier
Goddard Enterprises Inc. is not responsible for carrier charges
Check with your mobile carrier for rate plan details

4.7 Number Porting and Reassignment

If your mobile phone number is reassigned to a new user:

We will detect and remove reassigned numbers from our lists
We will not send messages to reassigned numbers
New number owner must provide their own consent

4.8 Consent Revocation and Re-Subscription

You may revoke consent at any time using opt-out methods above
After opting out, you must provide NEW express written consent to receive messages again
Previous consent does NOT apply after opt-out
No automatic re-subscription

5. Arbitration Agreement and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

5.1 Agreement to Arbitrate

You and Goddard Enterprises Inc. agree to resolve all disputes through binding arbitration on an individual basis, except as provided in Section 5.2.

Covered Claims:

Claims arising out of or relating to these Terms of Service
Claims relating to SMS messaging, telephone calls, or TCPA (Telephone Consumer Protection Act)
Claims relating to privacy, data protection, or marketing communications
Any other claim arising from your use of our services

5.2 Class Action Waiver

YOU AND GODDARD ENTERPRISES INC. WAIVE ANY RIGHT TO:

Serve as a class representative
Participate as a member of a class of claimants
Participate in a class action lawsuit
Participate in consolidated or representative arbitration

All claims must be arbitrated on an individual basis. Arbitration will not consolidate or combine claims without the consent of all parties.

5.3 Arbitration Rules and Procedures

Arbitration will be administered by the American Arbitration Association (AAA)
Arbitration will be conducted in accordance with AAA’s Commercial Arbitration Rules
Arbitration will be held in Tennessee, unless otherwise agreed
The arbitrator has authority to award the same damages and relief as a court
Judgment on the arbitration award may be entered in any court with jurisdiction

5.4 Exceptions to Arbitration Agreement

Either party may pursue claims in small claims court while arbitration is pending. Nothing in this agreement prevents either party from seeking injunctive relief in court for intellectual property infringement or other urgent matters.

6. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the State of Tennessee and federal law, including the TCPA (47 U.S.C. § 227) and FCC regulations.

Any disputes will be resolved in accordance with the Arbitration Agreement in Section 5, or if not subject to arbitration, in the state or federal courts located in Davidson County, Tennessee.

7. Intellectual Property Rights

All content on this Site, including text, graphics, logos, images, and software, is the property of Goddard Enterprises Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GODDARD ENTERPRISES INC. SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Lost profits, lost data, or business interruption
Errors or omissions in content
Viruses or other harmful components
Unauthorized access to or use of our secure servers

Total liability shall not exceed the amount you paid, if any, for our services.

9. Indemnification

You agree to indemnify and hold harmless Goddard Enterprises Inc. from any claims, damages, losses, liabilities, and expenses arising from:

Your violation of these Terms of Service
Your violation of any third-party rights
Your violation of applicable laws or regulations

11. Termination of Service

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice.

Upon termination:

Your right to use our services ceases immediately
Provisions of these Terms that should survive termination will continue
Any outstanding obligations or payments remain due

12. Modifications to Terms of Service

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our Site.

Your continued use of our services after changes constitutes acceptance of the new terms.

13. Severability
